1. General Provisions
1.1. These Terms of Service (hereinafter — the "Terms") set out all material terms for the provision of the Ekle service and constitute a binding agreement between Furtaev Ilia, Individual Entrepreneur registered in the Republic of Armenia, TIN 20354437, state registration number 286.1599034 (hereinafter — the "Provider"), and any individual using the Service (hereinafter — the "User").
1.2. Ekle (hereinafter — the "Service") is a software product for learning Turkish, comprising an iOS application and a server-side API, together with the website at https://ekle.app. The Service provides dictionary lookup, morphological analysis of inflected word forms, grammar reference material, pronunciation, and spaced repetition of saved words.
1.3. Acceptance of these Terms occurs:
- for the free tier — upon first use of the Service;
- for the paid tier — upon the User completing payment in the manner set out in Section 4.
Acceptance constitutes the User's full and unconditional agreement to all of these Terms. If the User does not agree, the User must stop using the Service.
1.4. From the moment of acceptance, these Terms have the force of an agreement concluded between the Provider and the User.
1.5. The Provider may amend these Terms by notifying the User no less than 10 (ten) calendar days before the amendments take effect, by publishing an updated version on the Service website or through the Service interface.
2. Account
2.1. The Service requires no account to be used. Dictionary lookup, morphological breakdown, the grammar reference, pronunciation and the shareable breakdown card work without registration and without a network connection.
2.2. An account is required only to save a word, and therefore to use spaced repetition, streaks and statistics, because those are stored on the server so that they survive a change of device.
2.3. The account is created with Sign in with Apple, which is the only supported method. There is no password to set or lose. The User is responsible for maintaining access to, and the security of, their Apple ID.
2.4. The User may delete their account at any time from Profile → Settings → Delete account. Deletion is immediate and permanent; see the Privacy Policy, Section 9, for exactly what it removes.
2.5. The Provider may suspend or delete the User's account in the event of a breach of these Terms.
2.6. The User confirms that they meet the minimum age required to consent to the processing of personal data in their country of residence, or that they use the Service with the consent of a parent or legal guardian where required.
3. Service Description and Tiers
3.1. The Service is provided on an "as is" basis.
3.2. The Service is provided under the following tiers:
Free tier — permanent, not a trial period:
- dictionary lookup of any word or inflected form — unlimited;
- full morphological breakdown into stem and suffixes, with each suffix named;
- pronunciation audio and phonetic transcription;
- fuzzy and diacritic-insensitive search;
- unlimited saving of words;
- the starter frequency deck;
- the shareable breakdown card;
- spaced repetition, limited to a fixed number of reviews per day.
Paid tier (Premium):
- the Reader — analysis of arbitrary pasted Turkish text;
- full explanations of each suffix, including rules and exceptions;
- complete verb and noun paradigms;
- the grammar reference organised by CEFR level;
- all frequency decks;
- unlimited daily reviews.
3.3. The number of daily reviews on the free tier is the only usage limit in the Service, and it is displayed to the User within the application.
3.4. The Provider may modify the composition of the tiers, their pricing, and restrictions, with no less than 10 (ten) calendar days' notice to the User. A change in price never applies to a period the User has already paid for.
4. Payment Terms
4.1. All purchases are made through Apple (App Store In-App Purchase). The Provider does not sell the paid tier by any other means, does not process payments, and does not receive, store or have access to the User's bank card details.
4.2. Premium is an auto-renewing subscription, sold on a monthly or an annual period. The price, in the User's own currency, is shown by the App Store on the purchase screen before the purchase is confirmed.
4.3. There is no free trial and no introductory offer. The subscription is charged at full price from the moment of purchase.
4.4. Payment is charged to the User's Apple ID at confirmation of purchase.
4.5. Auto-renewal. The subscription renews automatically at the end of each paid period at the then-current price, unless the User cancels at least 24 hours before the end of that period. The Apple ID account is charged for renewal within 24 hours of the end of the current period.
4.6. Cancellation is performed by the User in their Apple ID subscription settings (on iOS: Settings → your name → Subscriptions), not within Ekle. Deleting the Ekle application, or deleting the Ekle account, does not cancel a subscription.
4.7. Refunds are handled exclusively by Apple under Apple's own policy; the Provider cannot issue them. Where Apple refunds a purchase, the corresponding Premium access ends. This does not affect any mandatory consumer rights available to the User under applicable local law.
4.8. The service is deemed rendered from the moment the User is granted access to the paid tier functionality.
5. User Rights and Obligations
5.1. The User is entitled to use the Service in accordance with these Terms, and to the functionality of the tier they are on.
5.2. The User undertakes not to:
- attempt to break, overload, or circumvent the technical restrictions of the Service;
- extract, copy or redistribute the dataset bundled with the application, in whole or in substantial part;
- resell, sublicense or otherwise make access to the Service available to third parties;
- use the Service for any unlawful purpose.
6. Provider Rights and Obligations
6.1. The Provider is entitled to:
- suspend or restrict the User's access to the Service in the event of a breach of these Terms;
- carry out maintenance work involving temporary suspension of access, notifying Users in advance where possible;
- send Users service communications;
- engage third parties for service delivery (hosting, authentication, purchase verification).
6.2. The Provider undertakes to:
- maintain Service availability within reasonable limits;
- protect Users' personal data in accordance with applicable data protection law and the Privacy Policy;
- notify Users of changes to these Terms;
- respond to User inquiries within a reasonable timeframe.
7. Intellectual Property
7.1. All exclusive rights to the Service (including source code, design, logos, and the trade name "Ekle") belong to the Provider.
7.2. Use of the Service does not grant the User any rights to the intellectual property of the Provider, except for a limited, non-exclusive licence to use the Service in accordance with these Terms.
7.3. The Service incorporates third-party material, which remains subject to the terms applicable to it. Section 7.1 is limited accordingly.
7.4. The list of words saved by the User is the result of the User's own use of the Service. The Provider makes no claim to exclusive rights over it and uses it solely to provide the Service to that User.
8. Limitation of Liability
8.1. The Service is provided "as is". The Provider does not guarantee uninterrupted or error-free operation of the Service, nor the accuracy or completeness of any dictionary entry, morphological analysis, grammatical explanation, transcription or audio.
8.2. Ekle is a study tool. It is not a translation service and is not a substitute for a teacher or a professional translator. The User should not rely on the Service where an error would have material consequences.
8.3. The Provider is not liable for:
- losses arising from the use of, or inability to use, the Service;
- the accuracy of automatically produced morphological analysis;
- actions of third parties who gained access to the User's account through the User's fault;
- temporary unavailability of the Service due to maintenance or force majeure.
8.4. The aggregate liability of the Provider under these Terms is limited to the amount paid by the User for the last 3 (three) months of Service use. For users of the free tier, the Provider's liability is excluded to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Use of Third-Party Services
9.1. The Service interacts with third-party services for authentication, purchase verification and hosting. It does not send the words, phrases or texts entered by the User to any third party: dictionary lookup, morphological analysis, grammar content and pronunciation are performed on the User's own device.
9.2. Use of third-party services is governed by their own terms of service and privacy policies. The Provider is not liable for the acts or omissions of third parties.
9.3. The Provider transfers to third parties only the minimum data necessary. A list of recipients is provided in the Privacy Policy, Section 7.
10. Dispute Resolution
10.1. All disputes arising from these Terms shall first be addressed through negotiation. The response period for a claim is 30 (thirty) calendar days.
10.2. If a dispute cannot be resolved through negotiation, it shall be resolved in accordance with the governing law set out in Section 11, without prejudice to any mandatory rights of consumers to bring proceedings in their country of residence.
11. Governing Law and Miscellaneous
11.1. These Terms are governed by the law of the Republic of Armenia, without prejudice to any mandatory consumer-protection rights available to the User under the law of their country of residence.
11.2. These Terms take effect from the date of their publication on the Service website and remain in force until withdrawn by the Provider. The agreement concluded on the basis of acceptance remains in effect until the User's account is deleted or the Service is discontinued.
11.3. If any individual provision of these Terms is found to be invalid, this does not affect the validity of the remaining provisions.
11.4. Failure by the Provider to act upon a breach of these Terms does not deprive the Provider of the right to take appropriate action at a later time.
11.5. The Provider may discontinue the Service by giving Users no less than 30 (thirty) calendar days' notice.
